The act of murder is punished. The punishment is more severe if the murder is premeditated rather than a crime of passion.
This is the way the laws are written. Same act, different consequences, and the difference is the thought process prior to the crime. What is this if not prosecution of a thought crime?
So in your opinion, should premeditation be dropped from consideration? I have no strong opinion on this, I never thought about it before, so I'm not trying to argue.
