Unless it is copyrighted, the photo is public domain and anyone who wishes can use it. The only thing illegal is if the tubes in the photo are represented as the actual tubes being sold. If the seller simply adds the caution, "Not actual tubes being sold but same type" then there isn't a problem.Just because you put something on the internet doesn't make it your own. (such as this email response)
