When CDs first arrived on the scene engineers didn't consider the minuscule amount of jitter to be of importance either. Turns out the human ear is very sensitive to small amounts of jitter. I think Malcolm's point is this signal dependent phase shift is very similar to jitter and a small amount may matter.
