This assumes perfect hearing capability - unless the listeners are teenagers the assumption is incorrect. The term "incontrovertible" is nonsensical (always counter one sweeping statement with another :-)
Recent research shows that human hearing is capable of temporal resolution down to 5 microseconds, which clearly indicates that in terms of audible transient information the 44.1 KHz sampling rate is inadequate by a factor of 10. It isn't all about frequency and aliasing, and a couple of journalists' listening test doesn't outweigh the science... what it actually shows it that their hearing has degraded to the point where they can't distinguish the information present in higher resolution standards.
