I was driving home Friday night, and they had set up a sobriety checkpoint on my route. Cop asked to see my license, looked at and remarked that my license had expired last month. It hadn't even occured to me to check-I've always gotten a renewal notice in the mail. So, he tells me pull in the parking lot so he can write a citation. After I pull over, he takes my license to run whatever data check they do. After 5 minutes or so, he comes and asks me why I'm driving on a license that has been suspended since 2008, and if I've been in any accidents. Needless to say, I'm in a total state of shock at this point-the only accident I've been involved in was when I was rear ended a few years ago, and the other driver's policy paid for everything. He confiscated my license, and told me to call someone to pick me up, and to take it up with the DMV. Went to the DMV (a half hour prior to opening and already the line was snaked around the building) and when I arrive at the window, she tells me the record shows I was in accident on my birthday in 2008 (I find the date interesting) and that I was uninsured. I tell her that I have been continuously insured on the same policy since 2004, and that I was most certainly not in accident-she says fill out form DL 208 and mail it in to Sacramento-takes 4 to 6 weeks to process. I ask if there any way to expedite the process as I need my car to get to work...she says nope, next victim please.
Unbelievable. I've express mailed the form along with a cover letter and proof of insurance, but how to prove you weren't in an accident when the state says you are? I'm wondering if I need an attorney.
