It sounds as if your lawyer has agreed to work on contingency if you can gather enough people together to make it economically viable for him/her. If you are unable to do this, perhaps you should consider filing a small-claims suit yourself against the individual or against Magnepan. That probably won't be enough to recover all of your damages, but it may be better than nothing, and the opposing party may be more agreeable to settling for partial damages. It certainly does sound as if you may have a valid complaint. But do consider looking into this quickly, as there are statutes of limitations to consider, and two years have passed already.
