...if the insurer issued the policy, it is a contract. If they sold you an insurance policy, they are obligated to fulfill their end of the contract. Now, that said, the contract may have "exclusions" or "limitations"--like if I wreck one of mine on the track, they won't pay a dime. It's up to them to "qualify" the policy-holder before they issue the policy. IF he actually had insurance, they'll pay what they are required and then cancel his policy immediately.
