RE: Any married guys here sign a prenup?

Yes, this is good advice - the prenup is handled differently across provinces as well.

These things would not be needed if courts were fair and the sides were honest in court.

Basically, it should be that whatever you had before getting married should be yours. Once you are married, everything should be fairly divided. If this was the case then prenups would not be needed.

My friend went through a divorce a few years back - they were married for 10 years - no kids. As soon as they got married she stopped working and sat at home and lived 100% off of him. He paid for everything - flights home, rent, food etc. He had enough and filed for divorce.

Her lawyers dragged it out for two years - he had to pay her rent for those two years. He had made several big offers to settle. She declined just to "get him." In Hong Kong, the judge looked at his offers and said they were fair enough so that in the end my friend did not have to cover her lawyer bills.

Still, he wound up losing over $300,000 Australian to her. Without kids mind you. His only satisfaction was that she had to pay her lawyer bills and she actually had the audacity to meet him a month later asking him to pay for her lawyers.

She got far less money in the end than if she had accepted his settlement proposal. Lawyers win - they are all quite happy to drag it through the courts for years and years.

So the prenup that might cost a few thousand is an attempt to get away from such a nightmare scenario down the road where the lawyers are running a couple hundred thousand dollars. Granted as a teacher in Hong Kong he can make up for what he lost in 2 years but he said he'll never get married again. If he had signed a prenup though - the stress might have been lessened and he might not be so jaded today to try again.

When he got married he was young and I saw her picture - she was stunning - he thought with the wrong head - can't blame him - she was definitely a top 0.1% looker from Shanghai. But Shanghai women do have a certain reputation - you marry them you are their slave.
