The difference is that the tobacco companies claimed that the product is safe. Gun companies claim that their product can kill you.
People are being charged if they allow their guns to be accessed to children and dealers or sellers can be charged if they sell guns to anyone that shouldn't have one. ATF needs to do their job and go after bad dealers and get guns off the street from the gangs.
How about crazy people? Should healthcare workers be responsible if they don't report crazy people that shouldn't have guns?
Should the FBI be responsible if they blow a background check resulting in a purchase that shouldn't have been made?
