the trespasser doesn't forfeit his rights by being on private property
they have the same right to self defense as the property owner
and any actions taken in self defense are weighed under the same laws
you'll see 'reasonable' mentioned in each and every statute on self defense
also several mistrials from defective jury instruction
which is certainly illustrative of the fact that many judges aren't very scholarly on law
