Aince it is NOT a Constitutionally specified number of Justices?
I think a simple 'law' authorizing it will do. Biden MAY push it with an Executive order.
BUT, the word EXECUTIVE implies control over 'The Executive', which is NOT the Judicial OR Legislative branch of the 3 theoretically Co-Equal branches. As it turns out? Number of justices has been a HIGH of 10 and I think 6.....And has changed 4 or 5 times before remaining stable in number since 1869....when It went to nine total.....
Further? It WOULD in all probability be a party line vote.
Too much is never enough
