How about 'we' back up to Article I, Section 8 of the Constitution

the Constitution does not confine the gov't to collecting taxes solely on income, their taxing power is far broader ... to whit:

"lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States"

the 16th Amendment added and defined income, and clarified that taxes on income would be collected without apportionment among the several States, and without regard to any census or enumeration

for emphasis: it did not supersede or replace Article I, Section 8 it added to it!

income taxes were collected before the Amendment but not uniformly

no one asked me but I hope this clears things up
