I don't know how the KX people dealt with this issue but I do know how the LAME people did. LAME stands for "LAME Ain't an MP3 Encoder" - yet another recursive acronym like GNU.
What they do is they only provide the sources, they never provide actual builds. So, by declaration, their work is merely another reference implementation. This way they don't infringe Fraunhofer's license model.
I guess the KX people do it the same way.Sometimes it still is useful to know how to deal with gcc, makefiles and stufflike that. That's "free" in the sense of "freedom", not in the sense of "free beer". I'm not sure but I believe this is how Richard Stallman once put it.
