The latest (Jan 2019) issue of QST - the American Radio Relay League (ARRL) publication that goes out to all members (including me)- has an article indicating that the FCC penalized a radio amateur $25,000 for continuing to operate an unlicensed FM radio station - on 90.9 Mhz for at least 5 years.
Most of the old-time "pirates" I remember reading about were broadcasting to one country from another or in international waters (abandoned WWII antiaircraft towers in the English Channel), so they escaped prosecution.
"Pirating" in the US is probably rare although there are boatloads of small FM transmitters and associated equipment available on Ebay. Those who do must "live in harmony" with their neighbors so as not to be reported to the spectrum police.
