As an Ebay seller of good repute, I can certainly understand lack of understanding of the term: "Seller is not responsible for damage in shipping".I use this in my terms every auction, however I also pack to a standard that is apparently much greater than most, judging from the posts regarding shipping damage. I have never had a shipping damage claim.
Maybe I am the Ebay exception to the bad packing rule, but once an item leaves my hands, it's the shippers responsibility to see that it is delivered properly, and without damage, it is my responsibility as a seller to pack the item as if it were I that was buying.
It is the buyer's responsibility to decide how much insurance goes on an item. As to who gets the payout, the buyer does, of course. After all it's the buyer that paid for the insurance. The seller has already been paid for the item, prior to shipping. If the buyer opted for more insurance than the item sold for, and the carrier paid it, then the buyer is entitled to all the settlement from the carrier, above and beyond the actual cost of the item to the buyer.
