Sampling frequency is only a single element of a design. Neither upsampling nor oversampling result in good sound on their own. Either can be better than the other.Upsampling is more complex than oversampling. Manufacturers are using the term "upsampling" to describe a system where the data is sampled in two stages. Because upsampling is more complex, it is trickier to implement. But the resulting sound, like anything in audio, has lot more to it than any single element.
I personally think that non-integer sampling of CD's (i.e. sampling at 96 or 192 Khz) is a needless complexity, developed simply for the sake of marketing.
