USA is different laws than the EU. Here the FCC only tracks down violators after complaints get made of a possible non compliant device. In EU they make you show your documentation of conformity stating you comply with the laws as verified by a certified tester before you are allowed to sell anything.
Low sales volume units or units so close to the legal limit the difference is negligible might break the law for an entire product life cycle without ever getting caught here in the US.
Guarantee you don't want that FCC fine, however. But usually, as far as I know, they will try and work with a manufacturer before fining them.
